Tyneside Mind believes that the health and wellbeing of all of our Users is of paramount importance.
Information contained on our website or in the formerly available Mood Tracker Application is not intended as a substitute for any type of professional medical services and should not be used for such purposes.

The Mood Tracker was not meant to diagnose illness or develop permanent treatment plans for health emergencies, health problems or diseases.
Use of the Mood Tracker is at your own risk. Tyneside Mind will not be liable for any injury, loss or damage caused or alleged to be caused by the use of the Mood Tracker Application or reliance on any content contained in the App or on our website.
Daily average mood is mathematically calculated based on your mood scores for that day, it may not accurately reflect how you feel.
Personal Use
This Application is for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, products or services obtained from this Application.
Data Storage
All registration data and information relating to you is subject to our website Privacy Policy.
No personal information is required in order for you to use the online Mood Tracker. Your email address will be connected to your account but name, age, location and gender are not required. You can choose to include all or some of this information in your online profile and by doing so you agree to us sending additional content from time to time including targeted notifications and polls.
No personal information is required in order for you to use the Mood Tracker App. By using the App, you agree to us storing a device ID against your mood data on our servers. If you choose to connect an online Mood Tracker account to your Mood Tracker App, this device ID will enable us to synchronise your past, present and future mood scores and journal entries between devices and your Tyneside Mind Mood Tracker account.
At any time, anonymised aggregated mood scores may used for statistical analysis, for example, to determine the mood of a nation.
User Content
We reserve the right to edit or modify any submitted content whether prior to or after publication and reserve the right not to publish any content which we deem to be offensive or inappropriate.
If you submit a real or screen name with a wellbeing tip, it will be displayed on the website.
We will try to make the Mood Tracker available at all times but cannot guarantee that it will operate continuously or be error free.
All data and content is monitored by the system and may be monitored by system admin for performance purposes.
Tyneside Mind reserves the right to collect and use anonymous usage data via the website and Application for our own use.
No Unlawful or Prohibited Use
As a condition of your use of this Application, you warrant to Tyneside Mind that you will not use said Application for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You must own or have the right to submit content for publication on the website.
Liability Disclaimer
Tyneside Mind uses reasonable endeavours to check the accuracy of information published on this Application. You should note however that Tyneside Mind does not warrant that such information will be error free and the user acknowledges that the information, products, and services published on this Application may include inaccuracies or typographical errors. Changes are periodically added to the information herein. Tyneside Mind reserves the right to make improvements and/or changes to the Application at any time.
This does not affect any statutory rights as a consumer.

This agreement is governed by the laws of England. You hereby consent to the exclusive jurisdiction of the English courts in all disputes arising out of or relating to the use of this Application. Use of this Application is unauthorised in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.
Tyneside Mind’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Tyneside Mind’s right to comply with law enforcement requests or requirements relating to your use of this Application or information provided to or gathered by Tyneside Mind with respect to such use.
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
This agreement constitutes the entire agreement between the User and Tyneside Mind with respect to this Application and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the User and Tyneside Mind with respect to this Application. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Any rights not expressly granted herein are reserved.
